Mindfulness Index is an offering from Monk@Work, the Mindfulness division of Strat-Board Business Services LLP. The following provisions form an agreement between Strat-Board Business Services LLP (Company / We / Us / Our) and you, as user or visitor of Mindfulness Index website (Platform).

Agreement

Agreement means this 'User Agreement', 'Privacy Policy', ‘Cookies Policy’ and any other terms, conditions or policies related to Platform or any of its parts or features. When you use the Platform or any of its related services, you are entering into a legal agreement, and agree to all the terms of Agreement.

User (Also referred to as 'you' / 'your')

  • A visitor or user on the Platform, including individuals or organizations being facilitated by a representative or associate of the Company.
  • An entity represented by any of the above.

Purpose

MEx enables individuals and organizations to assess their Mindfulness trait and related parameters by undertaking a psychometric assessment, with or without further support services (e.g. coaching and accelerator programs).

User's Obligations / Declarations:

Eligibility to use Platform:

  • Must be eligible to enter into legally binding contracts, under the applicable laws.
  • Must have attained the age of 18 years.
  • Have not been debarred, blacklisted or otherwise restricted from transacting business (generally or with any specific entity), by any statutory authority or by any business entity, in India or elsewhere.
  • Have not been found guilty of any fraud or legal breach by any court of law.

Declaration:

  • Users declare that they are undertaking the assessment on the Platform at their own discretion and voluntarily submitting the information and responses.
  • Users declare that they completely and clearly understand and agree to the purpose for which and the mode with which these responses and information are being collected by the Platform. Please refer to Privacy Policy for details on the information collected by the platform and the purpose for which it is utilized.

Representation:

  • Individual Users declare that they have complete authority to bind the organization for their actions made on their organization’s behalf. We shall not be responsible for any impersonation or unauthorized representation by any User.

Account Information:

  • Agree to receive notifications over Platform, email, call, SMS or other means of communication (even if contact details are on 'Do Not Call Registry').
  • Understand and agree that we will be required to share necessary details with statutory agencies, as per the governing law.

General Service Terms

  • Users undertaking assessment on the Platform are issued an Access ID, which is valid for one time use only. Users undertake to keep the same safe and secured and should not disclose it to anyone.
  • Company shall not be responsible the loss or any unauthorized use of Access ID.
  • Access ID is valid for a period of 30 days from the date of issuance. If it is not utilized within this period, the Company shall not be responsible for its renewal.

No refunds or cancellations

  • Purchases on the platform are final and not returnable or refundable.

Organizations, Coaches, Platforms:

If you are using the services of the Platform to offer services (with or without any consideration) to any individual(s) or organization(s), or in the course of your use of the Platform, any individuals (including your employees or customers) or organizations become Users of the Platform, with respect to such individuals and organizations:

  • You shall be responsible to maintain the confidentiality and privacy of their information, report and all other relevant data and details.
  • You understand that MEx report is strictly confidential and is intended to be viewed and utilized only by the individual undertaking the assessment or by any other person authorized by him/her. You undertake to take all the necessary actions to ensure this confidentiality and privacy. You shall ensure that your employees, affiliates and associates maintain the same level of confidentiality and privacy.
  • You shall be responsible for services / products provided to these individuals and organizations (with or without any consideration), whether or not based on the outcomes of Platform services. The Company and its associates shall not be liable for any reason whatsoever in this regard.
  • You shall comply with all applicable laws, including, but not limited to any privacy laws, intellectual property laws and regulatory requirements.
  • You acknowledge and agree that you may be held liable for losses incurred by the Company or its associates or Users arising out of any breach of these conditions.

No Guarantees / Warranties / Obligations:

  • Mindfulness Index (MEx) is an endeavor to support individuals and organizations assess their Mindfulness trait through a psychometric instrument.
  • The MEx profile / report is based on user’s responses to the standard MEx assessment. Like all other psychometric assessments, the contents & accuracy of this report are dependent upon the responses shared by the user.
  • This report is not intended to be definitive and recommendations shared are indicative in nature, which must be interpreted in conjunction with the additional evidences / feedbacks / inputs and in individual’s / organization’s specific context.
  • Any actions / decisions further to this report must be taken taking into account all the necessary considerations. Company and its associates shall not be liable for the contents of this report and / or decisions based on the report and / or consequences of those decisions.
  • Any interpretation or debriefing of this report must be done only by an expert or a Certified MEx Coach.
  • The Company makes no warranties of any kind as to the accuracy of the contents of assessments and reports, nor does it assume any responsibility for the consequences of any errors or omissions.
  • The Company expressly disclaims and accept and no liability for any loss arising from the use of Platform, assessment, report or any other services, or for any actions / decisions taken based on the same.
  • Company shall not be responsible for any error or omission with respect to the information placed on the Platform.
  • Company shall not be responsible for any operational or technical malfunctions / delays on the Platform.
  • The Company assumes no responsibility for the effectiveness of any encrypted data, nor guarantees that an encrypted algorithm is indecipherable. The Company makes no claim regarding the viability, integrity or invincibility of the encryption used and does not accept responsibility for any failure in this regard. By using the Pplatform services, you assume any risks that the encryption may be decipherable.
  • Some / all of the Platform services may be utilized / incorporated by other individuals / organizations in their service/ product offerings or they might become redistributors / resellers of Platform services. The Company shall not be responsible for any actions / omissions / transactions / contracts entered into by such individuals or organizations.
  • Further:
    • We do not provide any guarantee or claim for the quality, safety, or reliability of the Services.
    • We do not guarantee that the services will function without interruption or errors.
    • We shall not be liable if for any reason all or any part of the Platform is unavailable at any time or for any period.
    • We disclaim all and any implied warranties or representations.
    • We shall not be liable to Users or any other individual / organization for any direct / indirect / incidental / consequential / punitive / other damages or loss of whatsoever nature.
  • If, notwithstanding the foregoing, the Company is found liable for any damage or loss, you expressly agree that company’s aggregate liability shall be limited to INR Five Thousand Rupees.

Service Discontinuation / Modifications / Refusal:

Company reserves right to (without giving any notice / reason):

  • Refuse services to any individual / organization, at its own discretion.
  • Restrict / terminate / modify access of Users to particular functions / features / part of the Platform.
  • Discontinue / modify / add any particular functions / features / part of the Platform.
  • Discontinue any type of assessment reports or services.
  • Modify the content and structure of assessments, reports and any of the services related to the Platform
  • Modify the price of any of the services offered.
  • Modify any or all of the content of the Platform.

Intellectual Property Rights (IPR) and Other Ownership Rights:

  • Company is the sole owner of the complete Platform, including its design, framework, technical codes, text, images, audio files, video files, documents, etc.
  • You acknowledge that the Platform, its assessment and services have been developed with a substantial investment of time, effort and money and constitute valuable intellectual properties and trade secrets of Company. You agree to take all necessary caution and actions to to protect the proprietary rights of the Company and to avoid any infringement by you, your employees or your associates.
  • No part of the Platform or assessment or report or any other content related to the Platform can be reproduced, modified, copied or otherwise used for any purpose whatsoever.
  • Users give us unconditional, irrevocable and royalty-free rights to publish, display and reproduce the logo of their organization (without any further consent, notice or permission), for showcasing them as customers of the Platform / Company.
  • Trademark – Strat-Board, Monk@Work, MEx name, logo, icons are registered trademark(s) of Strat-Board. Any unauthorized use, modification, copy or publication of the same is strictly prohibited.

Other Terms:

  • This Agreement shall not be deemed to create any partnership, joint venture, or other joint business relationship between us and User(s).
  • The terms of this Agreement are applicable in conjunction with any other terms / conditions mentioned elsewhere, with respect to any specific services or part of the platform. This shall include any agreement / contract entered into by Company with the User or any of their associates or representatives.
  • Users are requested to read all the terms and conditions carefully. User’s continuance to use the Platform shall be deemed to be acceptance to all terms & conditions of this Agreement.
  • We reserve rights to amend this Agreement from time to time. Please check this page periodically for updates. Your continued use of services will constitute your consent and acceptance of these amendments.
  • Governing Law: This Agreement shall be governed and construed according to the laws of India and will be under the jurisdiction of the courts located in Pune, India.
